Friedrichs Gets Early Hearing
The Ninth Circuit issued an order referring Friedrichs’s Urgent Motion for Summary Affirmance to that court’s motions panel in either November or December. This means her case could possibly come before the Supreme Court in the current term, which ends next June, 2015.
The new order was a change from the court’s October 3 order, which referred the motion to the as-yet unnamed merits panel that would hear the full appeal. The new order means that Friedrichs will get a decision on her motion for summary affirmance by the end of December at the latest. If her motion is granted, she would be in a position to petition the Supreme Court for review, possibly by the end of the year.
