Further Findings From The District Court

The U.S. District Court for the Eastern District of New York ruled on some of the issues left unresolved in its opinion from September 11, 2006, in CIR’s challenge to a settlement agreement between the United States and New York City granting retroactive seniority to women and minority custodians employed by the Board of Education.

The court declared that Hispanic employees had been discriminated against in the City’s standardized tests. The Court also expanded the class of people who could join CIR’s class action suit to include “all custodial employees whose seniority for purposes of transfers, TCAs and layoff protection has been adversely affected by the grant of seniority benefits to the Offerees.”
