Board of Education 85 F. Supp. 2d 130 (E.D. N.Y.), rev'd, 260 F.3d 123 (2nd Cir. 2001). Issues: Civil Rights; Equal Protection.
Action: Challenging proposed settlement agreement in ongoing litigation between U.S. Department of Justice and the New York City Board of Education over alleged discrimination in recruitment, hiring and promotion of custodians in the New York City school system. Proposed agreement would offer blacks, Hispanics, Asians and women positions as permanent custodians with retroactive seniority dates.
Status: Pending. Victory before Second Circuit, August 3, 2001. Remanded for further proceedings.
