Rumsfeld v. FAIR

United States Supreme Court No. 04-1152


Issue: Freedom of Speech.

Action: Submitted a friend of the court brief to the United States Supreme Court urging it to uphold the Solomon Amendment, which requires colleges and universities to provide equal access to military recruiters as a condition of receiving federal funds. The brief notes that CIR's landmark 1995 Supreme Court case, Rosenberger v. University of Virigina rejected the view that public institutions may suppress expression of a particular point based solely on its content and/or the fact that administrators find it objectionable.

Status: Pending. Oral argument in the Supreme Court is scheduled for Dec. 6, 2005.
